Rock Art Brewery, a small craft brewery in Vermont, making American Style Barleywine-style beer called Vermonster, was served with a Cease and Desist order by Hansen Beverage Co. on September 14 2009 who make the patently ridiculous claim that
“use and registration of VERMONSTER in connection with beer will undoubtedly cause confusion and/or dilute the distinctive quality of Hansen’s Monster marks.”
Craft beer brewers, beer bloggers and enthusiats across the USA are uniting to support Rock Art Brewery in their battle against the forces of evil.
Rock Art Brewery are refusing to take it in the glass and have refused the cease and desist order. Vermonster is in fact a beer whereas the Monster Energy Drink is in fact not a beer, nor is it a Monster Jobs Site - surely if anyone should be sending out cease and desist orders it should be Monster.com or Mr Ver Monster or Tom and Jerry who make the Vermonster Ice Cream Sundae
Rock Art Brewery has contacted 5 trademark lawyers who all say that there is no infringement issue and this is clearly a "nuisance lawsuit". They add that the aim is to cause Rock Art Brewery to lose the case because Hansen have the financial means to wear Roack Art Brewery down to the point that they will not be able to fund the fight. Hansen will then win by default.
Rock Art Brewery owns the beer trademark to the vermonster in the state of Vermont.
